Conclusion
There
are three main points to keep in mind in responding to employee requests for a
religious exemption from an employer’s COVID-19 vaccination requirement. First,
employers must accommodate those employees whose sincerely held religious
beliefs do not allow them to be vaccinated against COVID-19, unless the
employer would suffer an undue hardship. Second, to determine whether the
employee is entitled to an accommodation, the employer is entitled to a full
and complete explanation of the employee’s religious belief and how it
precludes COVID-19 vaccination. Third, where an accommodation is called for,
the employer chooses the accommodation. It does not have to be to allow the
employee to continue performing their job duties unvaccinated but may include
reassignment or leave without pay.
